These Terms of Service ("Terms") govern your access to and use of the PollyApp mobile application, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use PollyApp. By using the Service, you represent that you meet these requirements.
2. Accounts and Access
- You may be required to create an account using Google, Apple, or other third-party login methods.
- You are responsible for keeping your login credentials secure.
- You are responsible for all activity that occurs under your account.
3. User Content
- You retain ownership of the content you create (polls, votes, comments, media).
- By posting, you grant PollyApp a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, display, and adapt your content in connection with operating and promoting the Service.
- You must not upload or share content that is illegal, abusive, harmful, obscene, infringing, or otherwise violates these Terms.
4. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes.
- Harass, threaten, or abuse other users.
- Impersonate individuals or misrepresent your identity.
- Attempt to hack, disrupt, or otherwise interfere with the Service.
- Upload viruses, malicious code, or engage in automated scraping.
5. Intellectual Property
- The PollyApp name, logo, design, and software are owned by us and protected by copyright, trademark, and other laws.
- You may not use PollyApp's branding without our permission.
6. Polls, Votes, and Results
- PollyApp provides polls and voting features for entertainment and informational purposes only.
- We do not guarantee the accuracy, reliability, or validity of poll results.
- Polls do not represent scientific surveys or professional research.
7. Termination
We may suspend or terminate your account at any time if you violate these Terms or if we believe your use poses risk to other users or the Service.
8. Disclaimers
- The Service is provided "as is" and "as available."
- We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee uninterrupted, error-free service.
9. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, or consequential damages.
- Our total liability for any claim relating to the Service shall not exceed $100 USD.
10. Governing Law
These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law principles. Disputes will be resolved in the courts located in Oregon.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance.
12. Child Safety
PollyApp is committed to protecting the safety and well-being of children. We have a zero-tolerance policy for content that sexually exploits or endangers minors.
- Age Requirement: The Service is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete it.
- Prohibited Content: You must not create, upload, share, or distribute any content that sexually exploits minors (CSAM) or that is otherwise harmful to children. This includes content that depicts, promotes, or facilitates child sexual abuse or exploitation in any form.
- Reporting: If you encounter content that you believe sexually exploits or endangers a minor, please report it immediately to us at support@pollyapp.net. We will investigate and take appropriate action, including removing the content and reporting it to the National Center for Missing and Exploited Children (NCMEC) and/or law enforcement as required by law.
- Enforcement: Violations of this section will result in immediate account termination and may be reported to relevant authorities.
